The Tribunal Orders that the appeals are allowed and Hamilton Zoning By-law No. 05-200 and Flamborough Zoning By-law No. 90-145-Z are hereby amended as set out in Attachments '1' and '2' to this Order. The Tribunal authorizes the municipal clerk of the City of Hamilton to assign numbers to these by-laws for record keeping purposes.
The Tribunal orders that the appeal is allowed and the Applicant's Official Plan Amendment for the Urban Hamilton Official Plan is amended as set out in Attachment '3' to the Order.
The Tribunal Orders that the Applicant's Subdivision Appeal pursuant to s. 51(34) of the Planning Act is allowed in principle, and that the Draft Plan of Subdivision dated June 21, 2023, surveyed by Rob Querubin, Ontario Land Surveyor, and prepared by MHBC, set out in Attachment '4' to this Order is approved subject to the imposition of Conditions that may be required by the City of Hamilton.
